Intellectual Property

All content published and made available on our Site is the property of Same for You Corp and the Site's creators. This includes, but is not limited to images, text, logos, documents, downloadable files and anything that contributes to the composition of our Site.

Age Restrictions

The minimum age to use our Site is 18 years old. By using this Site, users agree that they are over 18 years old. We do not assume any legal responsibility for false statements about age.

Acceptable Use

As a user of our Site, you agree to use our Site legally, not to use our Site for illegal purposes, and not to:

• Harass or mistreat other users of our Site;
• Violate the rights of other users of our Site;
• Violate the intellectual property rights of the Site owners or any third party to the Site;
• Hack into the account of another user of the Site;
• Act in any way that could be considered fraudulent;
• Post any material that may be deemed inappropriate or offensive; or
• Use as a username a name that is otherwise offensive, vulgar or obscene.

If we believe you are using our Site illegally or in a manner that violates these Terms and Conditions, we reserve the right to limit, suspend or terminate your access to our Site. We also reserve the right to take any legal steps necessary to prevent you from accessing our Site.

Accounts

When you create an account on our Site, you agree to the following:

1. You are solely responsible for your account and the security and privacy of your account, including passwords or sensitive information attached to that account; and
2. All personal information you provide to us through your account is up to date, accurate, and truthful and that you will update your personal information if it changes.

We reserve the right to suspend or terminate your account if you are using our Site illegally or if you violate these Terms and Conditions.

Limitation of Liability

Same for You Corp and our directors, officers, agents, employees, subsidiaries, and affiliates will not be liable for any actions, claims, losses, damages, liabilities and expenses including legal fees from your use of the Site.

Indemnity

Except where prohibited by law, by using this Site you indemnify and hold harmless Same for You Corp and our directors, officers, agents, employees, subsidiaries, and affiliates from any actions, claims, losses, damages, liabilities and expenses including legal fees arising out of your use of our Site or your violation of these Terms and Conditions.

Applicable Law

These Terms and Conditions are governed by the laws of the State of California.

Dispute Resolution

Subject to any exceptions specified in these Terms and Conditions, if you and Same for You Corp are unable to resolve any dispute through informal discussion, then you and Same for You Corp agree to submit the issue before a mediator. The decision of the mediator will not be binding. Any mediator must be a neutral party acceptable to both you and Same for You Corp.

Notwithstanding any other provision in these Terms and Conditions, you and Same for You Corp agree that you both retain the right to bring an action in small claims court and to bring an action for injunctive relief or intellectual property infringement.

Additional Terms

Class Action Waiver. You agree that any claim or proceeding arising from these Terms must be brought in your individual capacity and not as a plaintiff or class member in any purported class or representative proceeding which any related rights you hereby waive unless prohibited by law.

Jury Trial Waiver. You and we acknowledge and agree that we each waive the right to a trial by jury.

Resolving Disputes. Most of your concerns can be resolved quickly and to everyone's satisfaction by contacting us. If we're unable to resolve your complaint to your satisfaction (or if we haven't been able to resolve a dispute we have with you after attempting to do so informally), you and we agree to resolve those disputes in the ordinary courts based on the applicable law and venue set out in these Terms and all proceedings will be conducted in English.

Changes to Terms. We can make changes to these Terms at any time without prior notice. If we update these Terms we will notify you in your account. The new Terms will not apply retroactively to your use of Same for You and Same for You Merchant apps before the Terms changed, but the new Terms will immediately apply to your continued use of Same for You and Same for You Merchant accounts. Your continued use of Same for You and Same for You Merchant account will constitute acceptance of the revised Terms.

Warranty Disclaimer.
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SAME FOR YOU CORP EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT.

SAME FOR YOU CORP MAKES NO WARRANTY THAT:
(a) THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE;
(b) THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE SERVICE WILL BE ACCURATE OR RELIABLE; OR
(c) THE QUALITY OF ANY PRODUCTS, SERVICES, INFORMATION, OR OTHER MATERIAL PURCHASED OR OBTAINED BY YOU THROUGH THE SERVICE WILL MEET YOUR EXPECTATIONS.

Specifically, SAME FOR YOU CORP acts solely as an intermediary platform to facilitate food orders between users and third-party vendors (e.g., restaurants, caterers, or other food providers AND OTHER VENDORS OR COMPANIES). SAME FOR YOU CORP does not prepare, package, or deliver food, and makes no representations or warranties about the safety, quality, freshness, ingredients, allergen information, or any other characteristics of the food provided by these third parties.

You acknowledge and agree that any food or related products and non-food related services or products you obtain through the Service are solely the responsibility of the third-party merchant providing such products. In the event of a complaint, dissatisfaction, or a request for a refund, you must contact the merchant or establishment directly. SAME FOR YOU CORP is not responsible for handling complaints, issuing refunds, or resolving disputes related to food orders.

Third-Party Responsibility Acknowledgement.
All transactions made through the Service are solely between you and the applicable third-party vendor. SAME FOR YOU CORP is not a party to, and assumes no responsibility for, any such transactions.

Allergen & Dietary Responsibility Disclaimer.
It is your responsibility to review all ingredient and allergen information provided by the vendor. SAME FOR YOU CORP does not guarantee the accuracy or completeness of such information and shall not be liable for any adverse health reactions or dietary issues.

Local Law & Health Code Disclaimer.
Vendors are solely responsible for complying with local health, safety, and food handling regulations. SAME FOR YOU CORP does not independently verify vendor compliance and disclaims any liability arising from non-compliance.

Limitations of Our Role.
SAME FOR YOU CORP does not act as an agent or representative of any merchant, and nothing in this Agreement shall be construed as creating a partnership, joint venture, or agency relationship between SAME FOR YOU CORP and any vendor.

Force Majeure / Service Disruptions.
SAME FOR YOU CORP shall not be liable for any failure or delay in performance due to causes beyond its reasonable control, including but not limited to acts of God, weather events, food shortages, labor shortages, or internet outages.

Severability

If at any time any of the provisions set forth in these Terms and Conditions are found to be inconsistent or invalid under applicable laws, those provisions will be deemed void and will be removed from these Terms and Conditions. All other provisions will not be affected by the removal and the rest of these Terms and Conditions will still be considered valid.

Changes

These Terms and Conditions may be amended from time to time in order to maintain compliance with the law and to reflect any changes to the way we operate our Site and the way we expect users to behave on our Site. We will notify users by email of changes to these Terms and Conditions or post a notice on our Site.
